Kevin W. Fisher B.A.(Hons.), LL.B.
Called to New Brunswick bar in 1994 and the Ontario bar in 1996
Kevin received his B.A.(Hons) from the University of New Brunswick and his LL.B. from Osgoode Hall Law School in Toronto. He was admitted to the New Brunswick bar in 1994 while working for Stewart McKelvey Stirling Scales.
Kevin returned to Toronto in 1994 and was admitted to the Ontario Bar in 1996. He is a litigation partner at Basman Smith, acting for a broad range of companies and individuals in complex commercial disputes involving contract interpretation, shareholder and partnership issues, oppressive conduct, fraud investigations and debtor/creditor matters. Kevin acts for many creditors involved in disputes under Bankruptcy and Insolvency legislation and the Personal Property Security Act (PPSA) and has been successful counsel in leading decisions in these areas. Kevin is also recognized as a leader in enforcing creditors’ rights and is at the forefront of strategy development to overcome enforcement and collection impediments.
Kevin’s commercial litigation practice also includes the protection of intellectual property and rights enforcement against piracy for local, national and internationally based clients, particularly in the area of broadcast signal theft and issues related to copyright protection and the Radiocommunication Act.
He also acts as counsel to companies and individuals in employment and wrongful dismissal matters for both litigation and non-litigation issues, including as a consultant to assist clients in finding negotiated solutions to employment disputes.
He has extensive personal and legal experience in the construction industry and continues to act for many clients in contractual issues and lien matters under the Construction Lien Act.
Kevin has been a frequent speaker before the Ontario Bar Association on litigation, advocacy and collection and enforcement issues. Kevin is a former council member of the Canadian Bar Association Provincial and National Councils and is past Chair of the Ontario Bar Association (YLD) Continuing Legal Education committee. Kevin is a member of the Intellectual Property Institute of Canada (IPIC) and the Ontario Bar Association Civil Litigation Executive.
He is active in many charitable organizations, is a former committee member of the Toronto International Film Festival’s (TIFF) Film Crew and is currently a Gold Patron sponsor of TIFF. Kevin has many personal interests, loves to travel and is an avid hockey player.
